Welcome to GentleMao ("the Service"). The Service is developed and operated by the GentleMao Team ("we," "us," or "our"). Please read these Terms of Service ("Terms") carefully before using the Service. By downloading, installing, registering for, or using the Service, you agree to be bound by these Terms.

1. Description of Service

GentleMao is a mobile application designed for pet hospice care, providing the following features:

The Service is intended to help pet owners record and manage pet care information and provide supplementary reference information through AI technology. The Service does not provide veterinary diagnoses, medical advice, or treatment plans.

2. Accounts & Security

2.1 Account Registration

Use of the Service requires account registration. You may register via email, Apple Sign In, or Google Sign In. You agree to provide accurate, current information and to keep your account information up to date.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not share your account with others. We are not liable for unauthorized access to your account except where caused by our negligence. If you suspect unauthorized use, notify us immediately at pawpeace0225@gmail.com.

2.3 Account Deletion

You may delete your account at any time through the "Settings" page within the app. Upon deletion, all personal data, pet records, media files, and AI analysis caches will be permanently removed within 30 days and cannot be recovered.

4. AI Feature Terms

4.1 Nature of AI Features

All AI features provided by the Service (including but not limited to blood test analysis, symptom assessment, drug interaction check, dietary suggestions, weekly care report, and vet visit helper) are supplementary reference tools. Their outputs:

When AI features are used, your pet's care data (care-related data only, excluding owner personally identifiable information) is transmitted to a third-party AI service (Anthropic Claude) for processing. For full details, see our Privacy Policy.

5. Intellectual Property

5.1 Our Rights

The Service's software, interface design, icons, text content, care knowledge base articles, and other intellectual property are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or otherwise use these materials without our prior written authorization.

5.2 Your Content

Content you upload through the Service (including photos, text, voice memos, etc.) remains your intellectual property. You grant us a non-exclusive, royalty-free license to use such content solely as necessary to provide the Service (e.g., storage, transmission, display).

5.3 AI-Generated Content

You are free to use analysis results, suggestions, and other content generated by AI features. However, please note that AI-generated content carries no guarantee of originality and may be similar to content received by other users.

6. Disclaimers

6.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Subscriptions & Payment

7.1 Subscription Plans

The Service offers a free plan and paid subscription plans. Details and pricing are available on the Plans & Pricing page.

7.2 Payment Method

Paid subscriptions are processed through the Apple App Store in-app purchase mechanism. All transactions are subject to Apple's terms and conditions.

7.3 Auto-Renewal

Paid subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period. Renewal charges the same plan at the same price.

8. Service Changes & Termination

8.1 Service Changes

We reserve the right to modify, update, or adjust the Service's features at any time. We will provide advance notice of material changes via in-app notification or email.

If we decide to discontinue the Service, we will provide at least 90 days' advance notice via in-app notification and email, along with a reasonable period to export your data.

9. Indemnification

You agree to indemnify, defend, and hold harmless GentleMao and its team members from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Dispute Resolution

10.1 Informal Resolution

Before filing any formal legal claim, you agree to contact us at pawpeace0225@gmail.com and attempt to resolve any dispute informally for at least 30 days.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

10.3 Jurisdiction

Any legal action or proceeding arising from these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

11. Changes to These Terms

We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date. We will notify you of material changes via in-app notification.

By continuing to use the Service after revised Terms take effect, you agree to be bound by the revised Terms. If you do not agree, you should discontinue use and delete your account.

12. Miscellaneous

12.1 Entire Agreement

These Terms (together with the Privacy Policy, Refund Policy, and AI Medical Disclaimer) constitute the entire agreement between you and us regarding the Service and supersede all prior oral or written agreements.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms of Service are governed by the laws of the State of California, United States. For disputes, the parties agree to the exclusive jurisdiction of the courts located in San Francisco County, California.
